On October 3, 2025, the U.S. Department of Transportation issued an Interim Final Rule (IFR) that temporarily suspends enforcement of Disadvantaged Business Enterprise (DBE) contract goals, good-faith efforts, counting, and commercially useful function (CUF) determinations until all recipients, including Hawaiʻi Department of Transportation (HDOT), complete a mandatory re-evaluation of all firms in their respective DBE Programs.
These changes directly affect:
- Prime contractors currently performing work on federal-aid projects
- Bidders on solicitations now being advertised
- Contractors preparing to bid work in the near future

With hopes of raising industry awareness regarding this matter, HDOT Office of Civil Rights (OCR) has prepared an IFR Fact Sheet (click here) summarizing what the IFR does, what it does not do, and how it impacts contractor responsibilities.
HDOT OCR will be hosting webinars for prime contractors, subcontractors, and other industry partners. During these sessions, we will cover:
- What the IFR requires
- How DBE enforcement is affected
- Instructions for bidders
- Guidance for contractors on active federal-aid projects
- What to expect during HDOT’s DBE re-evaluation period
